The vast majority of legacy gifts are made by bequest through a will or trust. There are also life income plans that provide you a steady stream of revenue, offer significant tax advantage and ultimately benefit the work we do.

Your Charitable Bequest

Your charitable bequest is the most important type of gift for sustaining a cruelty free future for animals. Here are three types of bequests to consider along with sample gift language for your Will or Revocable Living Trust:

1) Specific Bequest

A specific bequest of an asset such as a retirement plan results in no income taxes paid on the plan by your estate.

“I give, devise and bequeath to Humane Society of the Sierra Foothills, a 501(c)(3) nonprofit corporation of the State of California (Tax ID#32-0282752), located at 2945 Bell Road #175, Auburn, CA 95603, Choose one: 1. The sum of $__________. 2. _________ shares of stock in____________Company, or 3. My real property commonly known as ________________.”

2) Residual or Percentage Bequest

Residual bequests are often made after remembering relatives and friends, and usually in combination with a percentage bequest. A percentage is the most flexible because it allows your gift to appreciate in your will no matter which asset is used.

“I give, devise and bequeath to Humane Society of the Sierra Foothills, a 501(c)(3) nonprofit corporation of the State of California (Tax ID#32-0282752), located at 2945 Bell Road #175, Auburn, CA 95603, all the residue (or state a percentage) of my estate, including real personal property.”

3) Contingent Bequest

The Humane Society of the Sierra Foothills can be named as a contingent beneficiary in your will or personal trust if one or more of your specific bequests cannot be fulfilled.

“I give, devise and bequeath to Humane Society of the Sierra Foothills, a 501(c)(3) nonprofit corporation of the State of California (Tax ID#32-0282752), located at 2945 Bell Road #175, Auburn, CA 95603, (specific, residual or percentage language as above).”
